Personal Injury Cases

he fee Zivley Law Firm charges on all personal injury cases is contingent, which means we will not be paid unless you obtain money from a settlement or Judgment. To retain us we request clients to sign a Contingent Fee Contract which operates as a Power of Attorney and an Assignment of an interest in your case. Our fee under our Contingent Fee Contract is a percentage of the money we are able to obtain for your case. We also receive reimbursement of our case expenses if we are able to obtain money for your case. You will not be obligated to reimburse us for any of case expenses incurred for your case unless we are able to obtain money for your case. Upon the recovery of money for you case, expenses are reimbursed out of the client’s portion after attorney’s fees are deducted. Another way of explaining the fee agreement is simply, if we do not obtain money for your case, you will owe not owe any attorneys fees to Zivley Law Firm and will not be obligated to reimburse Zivley Law Firm for case expenses we incurred.

Business and Commercial Litigation, Consumer and Insurance Litigation and Probate Litigation

In Business and Commercial Litigation, Consumer and Insurance Litigation and Probate Litigation cases we charge an hourly fee for legal and paralegal services provided which are billed on a monthly basis. Any expenses incurred in the prosecution or defense of your case are also billed on a monthly basis. To retain us we request clients to sign an Engagement Letter that describes the specific legal matter undertaken and terms of representation. We may also request clients to provide an initial or additional retainer that we will hold in our Trust Account. Any unused retainer will be returned to the client at the completion of the case.

In some Business and Commercial Litigation, Consumer and Insurance Litigation and Probate Litigation matters, Zivley Law Firm may accept representation of a Plaintiff’s case on a contingent fee basis. The percentage under our contingent fee contracts in Business and Commercial Litigation and Probate Litigation matters varies and is negotiated on a case-by-case basis. In certain instances we may undertake representation of a Business and Commercial Litigation and Probate Litigation matter under a hybrid fee arrangement that is a combination contingent fee and hourly fee.
